I. GENERAL PROVISIONS

1. The warranty is granted for Obag Collection Products (hereinafter referred to as the "Product").
2. The warranty for the Product is granted by: FUHBP Retail spółka z ograniczoną odpowiedzialnością with its registered office in Radom (26-610 Radom) at ul. Henryka Sienkiewicza 36 lok. 5, entered in the register of entrepreneurs of the National Court Register in the District Court of Lublin Wschód in Lublin with its registered office in Świdnik, VI Economic Department of the National Court Register under the number 0001224082, NIP: 9482657570 with the share capital in the amount of 5,000.00 PLN

II. TERMS OF WARRANTY

1. The Guarantor guarantees proper operation of the Product within 24 months from the date of release of the Product to the Buyer.
2. The Guarantor's responsibility under the guarantee covers only defects arising from reasons inherent in the sold Product.
3. Complaint under the guarantee may be made, for example:
   • a. in writing to the address: Radzanów 54A, 26-807 Radzanów, Poland
   • b. by e-mail to the address: ciao@obagstore.eu
   It is recommended to provide in the description of the complaint: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of the defect; (2) the complaint request; and (3) contact details of the person submitting the Product complaint - this will facilitate and speed up the handling of the complaint by the Guarantor. The requirements stated above are in the form of a recommendation only, and do not affect the effectiveness of complaints submitted with the omission of the recommended method and description of the complaint.
4. The person entitled under the warranty should deliver at the expense of the Guarantor the Product under complaint together with the proof of purchase of the Product to the following address:

   or to the place where the Product was issued when the warranty was granted, unless the circumstances indicate that the defect should be removed in the place where the Product was at the time the defect was revealed. The risk of accidental loss of or damage to the Product during the time from its issuance to the Guarantor until its receipt by the Warranty holder shall be borne by the Guarantor.
5. Under this warranty, the Guarantor shall be obliged to remove defects in the Product if such defects become apparent within the period specified in the warranty. If it is impossible to remove the defects of the Product, the warranty holder is entitled, at the option of the Guarantor, to deliver the Product free of defects or to refund the price paid for the Product to the gift card, which the warranty holder may use on the website of the online store www.obagstore.pl. The gift card issued to the warrantee expires at the time of its use or after 6 months from the issuance of the gift card to the warrantee.
6. The guarantor is obliged to perform its obligations under the guarantee immediately, no later than within 14 days from the delivery of the advertised Product. This period is to be counted from the date of delivery of the Product by the warranty holder, or from the date of filing a complaint if the circumstances indicate that the defect should be removed at the place where the Product was when the defect was revealed. After exercising its rights under the warranty, the Guarantor shall deliver the Product to the warranty holder at its own expense.
7. If, in the performance of its obligations, the Guarantor has delivered to the warranty holder, instead of the defective Product, a defect-free Product or has made significant repairs to the Product covered by the warranty, the warranty period runs anew from the moment of delivery of the defect-free Product or return of the repaired Product. If the Guarantor has replaced a part of the Product, the above provision applies accordingly to the replaced part. In other cases, the warranty period is extended by the time during which, due to a defect in the Product covered by the warranty, the holder of the warranty could not use it.
8. The warranty is valid on the territory of the Republic of Poland.
9. The warranty does not exclude, limit or suspend the buyer's rights under the warranty regulations for defects of the sold thing.
10. The Guarantor's liability to the holder of the guarantee who is not a consumer, and from January 1, 2021. and, for contracts concluded from that date, also not being a natural person entering into a contract directly related to his/her business activity, when the content of that contract shows that it is not of a professional nature for that person, resulting in particular from the subject of his/her business activity, made available on the basis of the regulations on the Central Register and Information on Business Activity, regardless of its legal basis, is limited - both as part of a single claim and for all claims in total - to the amount of the paid price for the Product. In such a case, the Guarantor shall be liable only for typical damages foreseeable at the time of the conclusion of the contract and shall not be liable for lost profits to the warrantee against the entity to which this section applies.
11. The Guarantor's liability under the warranty does not include, in particular: damage resulting from normal operation or wear and tear, mechanical damage (cracks, scratches, abrasions, discoloration, damage caused by external forces lightning, power grid failure, fire, flooding, high temperatures and sunlight and chemical agents), damages caused by improper use and storage, deformation of the Product, inconsistent with the installation instructions, and damages caused by improper or inconsistent with the attached installation instructions, or resulting from modifications and construction changes made by the warranty holder. The Guarantor shall not be liable under the warranty for slight differences between the color of the Products presented in the photos available on the website of the online store and the actual color of the Products, as well as for slightly sharpened edges and left forms of the Products resulting from production.
